February, 1838 - The nine commissioners had chosen the original site of the town of Montgomery under the hill to be the seat of justice (county seat) of Montgomery County.  Chief Justice Jesse Grimes was holding open court there and Clerk Gwynn Morrison was filing documents there in February of 1838.

March 1, 1838 – At the first Montgomery County Commissioners Court meeting, C. B. Stewart as agent for W. W. Shepperd induces the Montgomery County Commissioners Court to move the site of the town of Montgomery by offering the county a one half undivided interest in 200 acres of land due south of the original site of the town of Montgomery.  “…[A]nd the question being also whether the place of the Town [of Montgomery] presented by C.B. Stewart as agent for W. W. Shepperd should be received the same was unanimously received and adopted.”
